Chile SUBTEL Introduces Self-declaration with QR Code for Short Range Devices

Exempt Resolution no. 737 updates the technical conformity procedure under the main telecommunications procedures of Resolution No. 1,985 (2017) which simplifies the approval procedures for short range devices (SRD). By removing the pre-market type approval requirements for these types of devices, it allows SUBTEL to focus more on other areas of telecommunications and post-market surveillance.

The SRD compliance model shifts to a technical self-declaration supported by a mandatory QR code label linking to an online declaration of conformity (DoC) and its supporting test reports. These types of products cannot be marketed or sold in Chile with this labelling scheme. Exceptions under this compliance would entail MICS or medical devices that operate under the short-range device criteria. Medical communications equipment shall seek formal homologation with SUBTEL.

The equipment type includes routers, IoT devices, wearable, headphones, smart home devices, and RFID tags/readers. These types of equipment commonly us Wi-Fi, Bluetooth, Zigbee, and RFID technologies.

All SRD products are now subject to market surveillance by SUBTEL. Non-compliant products are subject to fines and even sanctions. Local representation is also required now. Local contact information shall be listed in the DoC from the QR code link.
