    CE Marking and Self-Declaration

    In order to CE mark a product, the manufacturer or their representative in Europe has to make a self-declaration describing that the product is in conformity with the relevant Directives.

     

    New General Product Safety Regulation (GPSR)

    The European Commission introduced a new General Product Safety Regulation (GPSR) December 13, 2024. This regulation will affect the conditions for CE marking and the requirements for sales in Europe.

    Manufacturers must ensure that all products placed on the market are safe. This includes conducting thorough risk assessments and maintaining detailed technical documentation.

    Product Traceability

    There are stricter requirements for product traceability. Manufacturers need to ensure that products can be traced throughout the supply chain, which helps in quickly addressing safety issues.

    Obligations for Online Sales

    The GPSR includes specific provisions for online sales. Manufacturers must have a responsible economic operator established within the EU to handle compliance and safety issues.

    Accident Reporting

    Manufacturers are required to report accidents involving their products to the relevant authorities. This helps in monitoring and improving product safety.

    Market Surveillance

    There will be reinforced market surveillance rules. Authorities will have more power to monitor and enforce compliance, ensuring that unsafe products are quickly removed from the market.

    The regulation introduces specific rules for product recalls, including a mandatory recall notice template and the right to remedy for consumers. This ensures that recalls are handled efficiently and effectively.

    The Nemko Certificate of Conformity (CoC) Scheme

    The Nemko Certificate of Conformity (CoC) scheme provides 3rd party attestation that a product is in conformity with a particular standard. The CoC can be used to support the manufacturer in determining compliance of their product with mandatory European directives.

    Certificate of Conformity (CoC) – Type and Scope

    The Certificate of Conformity is issued as a Type 1a certificate / statement according to ISO/IEC 17067, meaning there is no certification mark associated with the scheme and no surveillance (i.e product retest or factory inspection).
    As there are no certification mark requirements of the scheme, the Certificate of Conformity does NOT give the manufacturer any rights to use the Nemko mark.

    Why choose the Certification of Conformity (CoC) from Nemko?

    As the potential consequences of not complying with GPSR may be substantial, many manufacturers want to involve a third party to verify that their products really comply with the regulatory requirements.

    Testing will be performed by Nemko labs or by a Nemko qualified partner laboratory.

    Application process follow identical process as for other Nemko certifcation schemes.

    The Certification of Compliance (CoC) can be used as part of the technical documentation that is mandatory to compile before manufacturer can issue the Self- Declaration (DOC – Declaration of Conformity) and CE mark the product.
